1. Scope and contract
These terms apply only to entrepreneurs under section 14 BGB. A contract begins on explicit confirmation or service activation; website content is an invitation to offer.
2. Service
Depending on plan, DailyDoc provides software, video, languages, managed LTE loan devices, remote administration and support.
- Base: 1 tablet, up to 100 videos, 2 languages
- Premium: 3 tablets, unlimited video and languages within the agreed scope
- Gold: 10 tablets, Premium features and agreed practice-exclusive content
3. 30-day trial
After approval, one preconfigured tablet may be tested free for 30 calendar days from confirmed receipt. There is no automatic subscription. Return it complete on the first business day after the trial using the prepaid process.
4. Devices and exchange
Loan devices remain DailyDoc property. Technical defects are exchanged after verification; intentional or grossly negligent damage, loss, theft and misuse are excluded from free exchange.
5. Prices and payment
Website prices are net EUR plus VAT. Billing cycle, due date and payment method follow the order confirmation.
6. Term and termination
Start, minimum term and renewal are stated in the order. Termination requires at least text form; loan devices must be returned.
7. Clinical responsibility
The practice checks content suitability and remains responsible for history, diagnosis, advice, disclosure and consent.
8. Rights and custom content
The practice receives a non-transferable right for the contract term. Rights remain with owners; the practice warrants rights for its own content.
9. Data protection
Where DailyDoc processes data for a practice, the parties sign an Article 28 GDPR DPA before processing.
10. Availability
No uninterrupted mobile or internet connection is promised. Necessary maintenance and security changes are permitted.
11. Defects and liability
Mandatory liability remains unaffected. For slight negligence of essential duties, liability is limited to foreseeable typical loss; any cap requires legal review in the individual agreement.
12. Confidentiality
Both parties protect non-public business, technical and medical information.
13. Final provisions
German law applies excluding the CISG. Jurisdiction may be agreed only where lawful and after the legal entity is verified.
